Ticketing
These terms and conditions set forth below apply to all Longines Global Champions Tour, Global Champions League and/or Tops International Arena events and apply to spectators at the “Events” and at the Venue indicated on the ticket.
The holder of such ticket shall, by purchase or use of the ticket, be (deemed to have been made) aware of and to have accepted these terms and conditions which is necessary to complete the ordering process.
DEFINITIONS:
a. Event: Events/Competitions organized by Global Champions Tour B.V. and/or by third parties, in name of the Global Champions organization indicated on the ticket;
b. GC: (i) Global Champions Tour B.V. Maastrichterweg 249, 5556 VB Valkenswaard, the Netherlands being the organizer of the Events, and (ii) Tops Equestrian Events B.V. Maastrichterweg 249, 5556 VB Valkenswaard, the Netherlands being the seller of the tickets;
c. Venue: the location of the Event / Competition covering playing field, stands, shopping village, and all surroundings;
d. Authorized person: police, medal support, steward, security officer, volunteer, employee or anyone else as such appointed by Global Champions;
e. Restricted Area: any area at the Venue that has not been explicitly marked as public area for spectators and/or only accessible for those with the right permission & accreditations;
f. Prohibited Item: drugs, alcohol, fire arms, glass, firework or any other item that causes danger to the environment, people and animals.
1 – ADMISSION TICKET
An admission ticket can consist of a document provided by or on behalf of GC or a an unique barcode or QR code provided by or on behalf of GC.
The admission ticket is issued once and gives in principal access to one person. If there is a group/family ticket, the admission ticket provides access to the number of people specified on the group ticket.
The admission ticket is and remain GC’s property. The admission ticket entitles the holder to attend the event. Only the holder of the admission ticket who is the first to show the admission ticket at the start of the Event is granted access. GC may assume that the holder of the admission ticket is also the person entitled to it (the customer). GC is not obliged to carry out any further verification of valid admission tickets. The customer must ensure that they become and remain the holder of the admission ticket issued by GC or by an advance sales organisation engaged by GC.
As of the time that the admission ticket has been given to the customer, the customer bears the risk of loss, theft, damage or misuse of the admission ticket.
Only purchases from the authorised advance sales organisations engaged by GC or from GC guarantee the validity of the admission ticket. The burden of proof in this regard lies with the customer.
The admission ticket that consists of a bar- or QR-code is supplied to the customer via electronic communication (email or app). If the customer has chosen to receive the admission ticket in this way, the customer must ensure that this admission ticket can be supplied through secure electronic communication. GC can neither guarantee the confidentiality of the supplied admission ticket nor the receipt of the admission ticket.
Admission tickets cannot be returned. The provisions of Article 6:230p sub e of the Dutch Civil Code apply to admission tickets. If this option is available, then a ticket may be offered for resale through a ticket exchange platform designated by GC.
2 – PROHIBITION AGAINST RESALE
The customer is obliged to keep the admission ticket for an Event for themselves and therefore not to resell it in any way to third parties, to offer it for sale or to give it to third parties for commercial purposes. Exempt from this prohibition is the sale of admission tickets through a ticket exchange platform designated by GC.
The customer who makes their admission ticket available to third parties for free and not for commercial purposes is obliged to impose the obligations imposed on the customer as described in the General Conditions on the person to whom the customer makes the admission ticket available. The customer guarantees to GC that this/these person(s) will comply with these obligations. GC can decide to sell admission tickets to an Event by name (i.e. personalized). In that case the admission ticket is non-transferable and - in deviation from the above - only the person in whose name the ticket has been given has access. GC is entitled (but not obliged) to check the identity of the holder of the admission ticket to determine whether it corresponds to the name on the admission ticket, and if it does not correspond, to refuse the holder of the admission ticket access to the Event.
If the customer does not comply with their obligations as described in the preceding paragraphs of this article and/or cannot guarantee them, the customer will owe GC an immediately payable fine of € 1,000 per violation and € 500 for each day that the violation has continued and continues, without prejudice to GC's right to demand compliance from the customer and/or compensation for the damage suffered or to be suffered.
3 – REFUNDS
GC has the right to reschedule the Event to a later date or to cancel it, for example in case of force majeure, which strikes, fire, bad weather conditions and epidemics.
If GC - for example as a result of or in relation to force majeure - cancels the Event before it has started, GC shall be obliged only to refund to the customer the price mentioned on the admission ticket. If an Event must be cancelled after it has started, GC shall only be obliged to refund a part of the price mentioned on the admission ticket. The customer will receive by electronic communication (email or app) from the sales organisation or GC about a refund of the ticket price. This email will mention the procedure and the response time. The aim is to send this message within 12 weeks after cancellation of the Event. Only the customer will be notified and is entitled to a refund. In the event of resale outside the official (pre)sales organisation or a GC designated ticket exchange platform, the customer will have to contact the original ticket buyer himself. The advance sales organisation shall decide on the refund of service charges in such cases. Other damages (including travel and accommodation costs) shall not be reimbursed. GC is not liable for any (other) loss suffered by a visitor as a result of the cancellation of the Event.
If GC, for example as a result of or in relation to force majeure, reschedules the Event, the admission ticket remains valid for the new date on which the Event will take place. If the customer cannot or does not want to attend the Event on the new date, the customer is entitled to return the admission ticket to GC or the sales organisation in exchange for a refund of the price mentioned on the admission ticket, or in the absence of such a price, the price (in principle excluding service charges) that the customer has paid through the sales organisation. The customer will receive an email from the (pre)sales organisation or GC about the refund possibilities of the ticket price. This email will mention the procedure and the response time. The customer must indicate within the specified response period that he wants a refund of the purchase price. If a customer fails to do so, the admission ticket will remain valid for the replacement date and the right to a refund will expire. The right to a refund expires in any case on the day of the replacement Event. Only the customer will be notified and is entitled to a refund. In the event of resale outside the official sales organisation or a GC designated ticket exchange platform, the customer will have to contact the original ticket buyer himself. within four weeks after the (old) date as stated on the admission ticket. The advance sales organisation will decide on the refund of service costs in such a case. Other damage (including travel and accommodation expenses) shall not be reimbursed. GC is not liable for any loss suffered by a visitor as a result of the postponement of the Event.
4 – CONDITIONS
1. Global Champions reserves the right at its reasonable discretion to make alterations to the time, date and/or Venue of any Event and/or Competition and/or to substitute a seat or area indicated on the ticket with another similar position.
2. All tickets are offered and sold subject to applicable Dutch laws and (local authorities) regulations and in accordance with these terms and conditions.
Any person entering the Venue is subject to these rules. Global Champions reserves the right to confiscate or invalidate any ticket held by a person infringing these rules.
3. Global Champions may refuse admission to or remove from the Venue anyone who, in its reasonable opinion:
a. does not produce a valid ticket upon request;
b. has infringed any of the applicable rules;
c. fails to comply with instructions from any Authorized Person,
d. enters any Restricted Area within the Venue
e. is in possession of a Prohibited Item.
f. any other reasons deemed acceptable by Global Champions to remove such person from the premises and/or deny his access
4. Any person purchasing or using a ticket and/or entering the Venue agrees:
a. to refrain from any conduct (whether by language, gesture or otherwise) likely to offend, insult, humiliate, intimidate, threaten, disparage, or vilify any other person (including players, match officials or spectators) on the basis of race, gender, sexual orientation, religion, culture, color, descent, national or ethnic origin.
b. not to sell, license or otherwise publish, disseminate or reproduce for any commercial purpose, including (without limitation) for any commercial reproduction and distribution, whether in whole or in part, any recordings taken or made at the Venue (including, without limitation, photographs, video or sound recordings, sketches, paintings) without the prior written consent of Global Champions; The making of any such image for any of the commercial purposes referred to above, is also prohibited without the prior written consent by Global Champions.
c. not to use a ticket for commercial purposes or hospitality by any person or company. Without prejudice to the generality of the foregoing, the holder of such a ticket shall not, as part of a hospitality package or for any other reason, purvey, advertise, or otherwise offer for sale, or use as a competition prize, the seat or seats allocated to that person without the written permission of Global Champions.
d. not to re-sell any ticket for an Event / Competition at a premium;
e. not to broadcast or narrowcast by any means whatsoever (including, without limitation, by way of mobile telephone or any other device) any images, sounds, data, results or commentary of or concerning any of the matches or other activities at the Venue without the prior written consent of Global Champions;
f. not to do any of the following:
i. public nudity or indecency;
ii. excessive noise or any interference with the Event / Competition or any other activity on the Event;
iii. throwing any object that might cause damage or discomfort to people or property and/or to horses in the arena/on the Venue.
iv. obstruct any gangway, access-way, exit, entrance or staircase;
v. standing on seats, climbing roofs, walls, fences, stands, lighting masts, trees or any other structures or constructions at the Venue;
vi. obstruct the view of other spectators
vii. wear or otherwise display commercial, political, religious or offensive signage or logos or engage in ambush marketing in any way;
viii. sell any goods or services at the Venue or in its immediate surroundings;
ix. handing out political, religious, advertising or promotional material;
x. bring any flags, banners, klaxons, rattles, fireworks or other articles into the Venue that may annoy other spectators; These may be confiscated when entering the Venue.
xi. enter a Restricted Area at any time unless explicitly authorized. Without prejudice to any other sanction, anyone entering the arenas/ground without permission with forfeit a penalty of Euro 1.000;
xii. use any radio sets, except in conjunction with an earpiece;
5. Any ticket holder is individually responsible for own properties brought to and into the Venue. There will be no storage facilities at the Venue. Global Champions accepts no responsibility or liability for theft or loss of or damage to such property.
Access to the location and attendance of the Event takes place at the risk of the visitor in the sense that GC accepts no liability or whatsoever for damage resulting from such access or attendance.
5 – OTHER TICKET POLICIES
1. If an Event is rescheduled to a different date or Venue, the original ticket will be valid for the rescheduled date if you have not chosen for the option to have a refund.
2. Global Champions nor anyone else will be liable for any associated costs, expenses or loss due to an Event being rescheduled, postponed, or cancelled (including, without limitation, any indirect and/or consequential loss, such as for travel or any accommodation costs).
3. No refund will be payable if a ticket holder is refused entry to or removed from the Venue because of a breach of the rules.
4. Global Champions will not accept tickets back for exchange or resale. However, if as a result of exceptional circumstances an applicant or ticket holder must return one or more tickets, Global Champions may take contact to solve this specific problem. When a client wants to make use of this arrangement, we explicitly ask you to explain your situation by email to [email protected] after which Global Champions will assess the situation.
5. Global Champions shall bear no responsibility for charges imposed on a ticket holder by any third party.
6. The amount to be paid and the master currency of the tickets are stated prior to purchase. In some cases, foreign exchange rate fees may be applied by your bank, resulting in the debited amount on your bank statement differing from the amount displayed in the ticket store.
7. Prices may vary and you will not be entitled to a refund if the price of similar Tickets subsequently changes.
6 – DATA PROTECTION
GC processes personal data of the customer, visitors and users in accordance with its privacy statement. The aforementioned privacy statement is available here.
The personal data for the purchase of tickets is for the purpose of executing the agreement with you. We use your personal date for processing your order, accepting your payment and providing you customer service. We do not retain data longer than necessary to provide the services you have requested.
7 – FINAL PROVISIONS
GC is entitled to change these general conditions unilaterally. In that case GC will inform the customer and visitor of the changes in a timely manner.
Any disputes that may arise as a result of the agreement between GC and the customer or the visitor will be exclusively settled by the court of ‘s Hertogenbosch unless the customer or visitor is not acting in the exercise of a profession or business and, within one month after GC has invoked this article in writing, has made it known that it chooses the court with jurisdiction under the law to settle the dispute.
